1. Acceptance of Terms
By accessing or using BeautifulOutdoorsKS.com, requesting a quote, scheduling services, or otherwise engaging with Beautiful Outdoors Lawn & Landscape (“Beautiful Outdoors,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.
2. Services Description
Beautiful Outdoors Lawn & Landscape provides professional lawn care, landscaping, and related outdoor services to residential and commercial customers in Kansas and the greater Kansas City area. Services may include lawn mowing, edging, and maintenance; landscape design and installation; mulching, planting, and bed maintenance; seasonal cleanups; weed control and fertilization; irrigation services; snow removal (where offered); and any other services quoted or agreed upon in writing. Service availability may vary by season and location. We reserve the right to modify or discontinue any service at any time.
3. Estimates & Quotes
All estimates are based on information available at the time of assessment. Final pricing may be adjusted if site conditions differ materially from what was assessed. Written estimates are valid for 30 days from the date of issuance unless otherwise noted. An estimate does not constitute a binding contract until both parties have agreed in writing. By scheduling or authorizing service after receiving an estimate, you agree to the pricing outlined in that estimate, subject to any on-site adjustments communicated prior to work beginning.
4. Payment Terms
Unless otherwise agreed in writing, recurring maintenance services are billed at the time of service or on a monthly basis; project-based services may require a deposit prior to scheduling; balances are due within 14 days of invoice date; and accounts more than 30 days past due may be assessed a late fee and/or suspended from service. We accept payment by check, major credit/debit card, and electronic transfer where available. Beautiful Outdoors reserves the right to pursue collection of unpaid balances, including reasonable attorney’s fees, as permitted by Kansas law.
5. Scheduling & Cancellation
Services are scheduled based on crew availability, weather, and routing. We will make reasonable efforts to notify you of your service date in advance. Services may be rescheduled due to inclement weather or unforeseen circumstances. We ask for at least 24 hours’ notice to cancel or reschedule; cancellations made with less than 24 hours’ notice may result in a fee for project-based services. Either party may terminate a recurring service agreement with 14 days’ written notice. Outstanding balances remain due upon termination.
6. Property & Access
By scheduling services, you grant Beautiful Outdoors and its employees permission to access your property to perform the agreed-upon work. You agree to ensure gates, pets, and obstacles are managed for safe crew access; notify us in advance of any underground utilities, irrigation heads, or hazards; and secure any fragile or valuable items. Beautiful Outdoors is not liable for damage resulting from pre-existing conditions, unmarked underground utilities, or obstacles not disclosed prior to service.
7. Limitation of Liability
To the fullest extent permitted by law, Beautiful Outdoors’ liability for any claim shall not exceed the total amount paid for the specific service giving rise to that claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind. Beautiful Outdoors carries general liability insurance; certificates are available upon request.
8. SMS & Text Message Communications
By providing your mobile number and opting in, you consent to receive text messages from Beautiful Outdoors, which may include appointment confirmations and reminders, service updates, estimate follow-ups, billing reminders, and seasonal promotions. By providing your mobile phone number to Beautiful Outdoors Lawn & Landscape and opting in to text message communications — whether via our website contact form, estimate request form, verbal agreement, or written consent — you agree to receive automated and manually sent SMS and MMS messages from us. These messages may include:
- Appointment confirmations and service reminders
- Crew dispatch and on-my-way notifications
- Estimate delivery and follow-up messages
- Invoice and payment reminders
- Seasonal service offers and promotions
- Responses to inquiries submitted through our website or by phone
Message frequency varies based on your service schedule and activity. Message and data rates may apply depending on your mobile carrier and plan.
To opt out of text messages at any time, reply STOP to any message you receive from us. You will receive one final confirmation message and no further texts will be sent. To request help, reply HELP or contact us directly at info@beautifuloutdoorsks.com. Opting out of SMS does not affect your ability to receive or continue services.
We do not sell, rent, or share your mobile phone number or SMS opt-in data with third parties for their marketing purposes. Consent to receive SMS messages is not a condition of purchasing or receiving any service.
Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, Metro PCS, U.S. Cellular, and other major U.S. carriers. Carrier liability is disclaimed.
9. Intellectual Property
All content on BeautifulOutdoorsKS.com — including text, images, logos, and design — is the property of Beautiful Outdoors Lawn & Landscape or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce or use our content for commercial purposes without prior written consent.
10. Governing Law
These Terms are governed by the laws of the State of Kansas. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the State of Kansas.
11. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our site or services after changes are posted constitutes acceptance of the revised Terms.
